______________MARRIAGE BOND of SHELAH GILLENWATERS
Know all men by these presents, that we SHELAH GILLENWATERS &
DAVID COCK Senr. of Scott County are held and firmly bound unto James
P. Preston, Governor of the Commonwealth of Virginia in the sum of one
hundred and fifty dollars; to which payment well and trully to be made
to the said Governor and his successors in office, we bind ourselves,
our heirs, executors and administrators, jointly and severally, by
these presents. Witness our hands and seals this 6th day of November
1818. The condition of the above obligation is such that whereas
there is a marriage shortly intended between SHELAH GILLENWATERS and
NANCY COCK. Now if there be no lawful cause to obstruct the same,
then this obligation to be void otherwise to remain in full force and
virtue.

I SHELAH GILLENWATERS of the County of Scott and the State of
Virginia being of sound mind and being fully impressed withthe
uncertainty of human life do make ordain and constitute the following
as my last will and testament. That is to say after all my just debts
are punctually paid off and my funeral expenses are fully discharged,
that my property remaining shall be disposed of as follows;
First, I give and bequeath to my wife Nancy during her natural life
all my household and kitchen furniture, all my poultry, all my sheep,
all my cattle, all my hogs and all my horses except four head as
herein specified, all my lands with the appurtenances there unto
belonging, my blacksmith tools and farming utensils, all my negroes
now at my house, Namely my black boy Man, my black boy Henry, my black
girl Rhoda and Harrer and their mother Ginny and all and every species
of progeny now in my possession together with the grain produced and
on my farm.
Second, I give and bequeath the four head of horses aforesaid to
JAMES GILLENWATER, my son a gray colt, third to SAMUEL L. GILLENWATER,
my son a clay bankhorse, fourth a clay bank filly to POLLY GILLENWATER
my daughter.
Third, at the death of my wife Nancy I will the following division of
negroes, that Ginny my oldest servant girl shall choose which one of
my children she will live with. That my black boy Mann shall go to my
son WILLIAM by William paying to my son DAVID two hundred dollars.
That my black boy Henry shall go to my two sons HAROLD C. and SAMUEL
L. by their paying my youngest daughter POLLY one hundred dollars
each. That my youngest daughter shall have my black girl Rhoda. That
my black girl Hannah be equally divided between the heirs of the
bodies of my two daughters, ELIZABETH GREEN and NANCY FRASUER.
Fourth, I will and give now to ELIZABETH GREEN my daughter my boy Edd
during her lifetime and then to the heirs of her body forever.
Fifth, I will and give now to NANCY FRAYSUER my daughter my boy Frank
during her lifetime and then to the heirs of her body forever.
Sixth, I will and give so soon as the term of hire expires with
HORTON my yellow boy Daniel, the said yellow boy to be equally divided
between my two sons ELIJAH C. and JOHN M. GILLENWATERS.
Seventh, I give up and will to my son ELIJAH GILLENWATERS the money I
paid out for his land amounting to three hundred dollars.
Eighth, I give up and will to JOHN M. GILLENWATERS my son the bond I
hold against him for three hundred and thirty or thirty six dollars.
Ninth, Iwill at the death of my wife NANCY, that my lands be equally
divided between my four sons WILLIAM GILLENWATERS, JAMES GILLENWATERS,
HAROLD C. GILLENWATERS, and SAMUEL L. GILLENWATERS, WILLIAM to have
his portion where he now lives having the benefit of himself for all
the improvements he may make, the said other three sons having to
themselves respectively the benefit of the improvement they may make.
Tenth, I will at the death of my wife NANCY, that all of my household
and kitchen furniture be equally divided between my three daughters,
ELIZABETH GREEN, NANCY FRAYSUER and POLLY GILLENWATERS and their
children forever.
Eleventh, I will at the death of my wife NANCY that all my farming
utensils and blacksmith tools be equally divided between my two sons
HAROLD C. and SAMUEL S. GILLENWATERS.
Twelvth, I will at the death of my wife NANCY that all my stock,
poultry, sheep, cattle, hogs and horses remaining in her hands be
equally divided between my two sons JAMES and DAVID GILLENWATERS.
Thirteenth, I give to my wife NANCY all the money I have on hand
together with notes and obligations after paying my just demands as
aforedaid reserving enough however to purchase a lot or parcel of land
on the North side of Clinch for the benefit of my farm from the
atorney in fact and indeed of Benjamin H. Warden and others.
Fourteenth, I constitute and appoint as executors of this my last
will WILLIAM GILLENWATERS and GEORGE W. JOHNSON. In witness whereof I
have this day signed my name and affixed my seal this 2oth day of
December 1856. Signed and sealed in the presence of us.
