In 1857 Sallie was married to E.E. Gillenwaters when her mother
came home to Hawkins County leaving her husband, Elijah, in his new
home in Monroe County, Kentucky. Rebekah's return may have been to
visit and help Sallie's younger sister, Malinda, who had just given
birth to another girl in August. In January of the following year,
Rebekah passed away and Sallie had her buried in the Bray Cemetery in
Stanley Valley on a hill overlooking Big Creek. Six months later,
Malinda and her husband buried their infant daughter beside Rebekah.
Also buried in this cemetery is an infant Joel Fletcher, born 14
August 1855, died 29 August 1855. I wonder if this was the first and
last child born to Sallie's brother, Joel Fletcher, and his wife,
Margaret Looney. Joel and Margaret had married in April 1854.
Reprinted in Volume VIII, Number 2 of the Distant Crossroads in
April 1991 was the followong marriage contract of Sarah W.
Gillenwaters and her third husband.
Articles of Agreement and Antenuptial Contract, made and entered
into on
this the 27th day of August, 1877, by and between A. L. Burem and
Sallie
W. Gillenwaters both of the County of Hawkins and the State of
Tennessee.
1st___The above named parties mutually hereby mutually agree to
intermarry
with each other on this the 27th day of August, 1877.
2nd___In consideration of said marriage it is agreed and
understood by the
parties above named that upon consummation of said marriage. the
said A. L.
Burem is to aquire no marital rights in the property of the said
Sallie W.
Gillenwaters, real or personal, nor in the rents, and profits,
interest and
accumulation arising from or growing out of same.
3rd___It is expressly agreed and understood that the said Sallie
W.
Gillenwaters, is, after said marriage, to have, enjoy and control
all the
property she may own at the time of the marriage, real, personal
or mixed,
and the rents, issues, profits and accumulations hereafter
arising therefrom
or growing out of the same in the same way and manner and to the
same extent
as she would do were she to remain an unmarried person, and the
said A.L.
Burem is to aquire no right therein by the marriage.
4th___It is further stipulated and agreed that at any time after
the said
marriageshall take place, that the said Sallie W. Gillenwaters
shall have
full power to dispose or any or all of said property and its
accumulation
by deed, will or otherwise as she may desire to do, in the same
way and to
the same extent as though she were to remain a femme sole.
5th___It is further stipulated and agreed by said parties that in
case
Sallie W. Gilenwaters should die in the lifetime of the said A.
L. Burem
owning property undisposed of, personal or real, the said A. L.
Burem is to
have no right or interest in the same.
6th___It is further expressly agreed and understood that the same
contract
and stipulations that are above made in reference to the
exclusion of any
rights that the said A. L. Burem might have to the property of
the said
Sallie W. Gillenwaters, shall apply to exclude the said Sallie W.
Gillenwaters from any rights that she might have to any property
owned
by the said A. L. Burem.
7th___It is further agreed that Samuel L. Chestnut shall be the
custodian
of this instrument after the same shall have been proven and
registered.
The foregoing agreement and contract is made and signed prior to
the
consummation of said marriage in the presence of
