POWELL ROBINSON and MARY A. ROBINSON SELL LAND to ISAAC L.
GILLENWATERS
"The July 1993 issue of Distant Crossroads, Volume X, Number 3
printed the following article extracted from the Register of Deeds,
Book 26, pages 67-68.
Registered this 5th December 1862 at 3 Oclock PM., Know all men
by these presents that we Powell Robinson and Mary A. Robinson this
day bargained and sold and by these presents doth bargain and sell and
confirm in consideration of the sum of One thousand dollars in hand
paid to us onto Isaac L. Gillenwaters a certain tract of land situated
in Hawkins County an the north side of Clinch Moutain and bounded as
follows:
Beginning on the top Holmans Ridge on two hickories and one black
walnut corner of E. R. Delp & Daniel Delp, Dec'd, thence with the top
of Holmans Ridge Eastwardly to a large pine tree on top of said ridge
thence north to a black oak near the corner of James D. Bloomer's
field a corner tree between Wm. J. Bloomer and James D. Bloomer thence
with the conditional line made and marked between said Bloomer and E.
R. Delp to a sugar tree stump and rock near the road on a small drain;
thence a north East course to a white oak tree Couches and Kyles old
corner then north twenty seven west ten poles to a white oak a corner
tree agreed upon between Wm J. Bloomer and Josiah J. Delp thence a
north west course with the conditional line to a beech tree on the
west side of a creek near the first ford above the bridge thence a
west course to the top of the bluff of rocks and with said bluff of
rocks to Clairbourn Roberts line thence with his line to Josiah J.
Delps old line thence with said line a south west course to near a
pine tree a tree line between Wm. J. Pearson and Daniel Delp; thence
south East course to the said pine tree thence with the conditional
line south east corner across the valley to a stake near a fence
thence East with a fence twenty rods to a cross fence a south east
course to the Beginning.
To have and to hold one half of the above described land it being
the portion purchsased by Mary A. Delp now Mary A. Robinson we bind
ourselves our heirs&c to warrant and defend this title to the said I.
L. Gillenwaters against the claims of all persons whomsoever. In
testimony where of we have hereunto set our hands and seals this 4th
day of May in the year 1860.

Esquire, you are hereby authorized and empowered to take the
examination of Mary A. Robinson pprivately and apart from her husband
relative to the execution of the within (or annexed) deed and the same
so taken to certify under your hand and seal. Witness James H. Davis,
Clerk at office this 3rd day of May 1860.

Powel Robinson, having personally appeared before me and having by
virtue of the authorization by me vested being examined privately and
apart from her said Husband and she having acknowledged the due
execution of the within (or annexed) by her freely voluntarily and
understanding by without compulsion or constraint by her said Husband
and for the purposes therein expressed the same is therefore
certified. Witness my hand and seal this 4th dqay of AMay 1860.____Wm.

State of Tennessee} Hawkins County____}___Personally appeares before
me James R. Pace, Clerk of the County Court of said County, Powel
Robinson ane of the above named bargainors with whom I am personally
acquainted and who acknowledged that he executed the within instrument
for the purposes therein contained.
Witness my hand at office this 5th day of December 1862.
Mary Ann was the daughter of Robert Kyle, Junior, and Rachel
Gillenwaters. She was a second cousin of E. E. Gillenwaters and I. S.
(I. L. above) Gillenwaters. Her grandfather was Thomas Gillenwaters
who migrated into Hawkins County with his brother Joel, the
grandfather of Dr. Isaac Shelby Gillenwaters and Edward Ervin
Gillenwaters.
Powell Robinson first married Minerva Gillenwaters, a sister of
Isaac Shelby; thus he had been a brother-in-law of Isaac. Minerva's
mother, Ellen Carmack, was a first cousin once removed of William E.
Carmack, the Justice of Peace who interviewed Mary Ann about her
willingness to sell her dower rights to the land.
Mary Ann was the widow of Daniel Delp whose sister, Sarah,
married James Asbury Kyle. This is a case of sister and brother
marrying a brother and sister.
This land sale occurred in 1860. In 1870 Powel and Mary were
still in Hawkins County according to census records; however, by the
1880 census they had migrated to Dade County, Missouri, presumably
along with her brother James Asbury Kyle and his wife Sarah Delp.
The relationship of E. R. and Josiah J. Delp to Daniel Delp is
unknown.
